Judge Sotomayor said in a 2001 speech at the Berkeley Shcool of Law,
“Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.”
She put this philosophy to work in the case: Ricci v. DeStefano. New Haven, Conn. firefighters were guilty of being white. They were denied promotions because no black firefighters were eligible for the promotions, based solely on test scores. New Haven had spent a large sum of money to insure the test was not racially biased. One of the white firefighters was hispanic. Judge Sotomayor was part of a 3 judge appeals court panel that rejected the white firefighters lawsuit.

Everything I’ve read about her shows that she is not a top legal mind. Did President Obama buy the ABA like he’s bought the banks, the car companies, and the media? Perhaps the ABA owns Obama and this is their way of making sure he succeeds.

The ABA is only slightly to the right of MoveOn.org. Bush (both I believe) ignored the ABA ratings and recommendations when selecting nominees. I believe that Obama made a comment about using the ABA if elected, and after the election, one of the ABA spokes holes commented that the ABA was “back where it belonged” or words to that affect.
I am not surprised that the ABA would BTMN’s nominee its highest rating.
